User Agreement – Jobs Portal

Agreement

Windsor Regional Employment Network (hereinafter “WREN”) is a service of Workforce Development Board Windsor Essex, and includes its related or affiliated entities, and their respective directors, officers, representatives, employees, consultants, agents, service providers, suppliers, and licensors.

You agree that by clicking “Register Now”, “Join Now”, “Sign Up” or similar, registering, accessing or using services of WREN, even if you are using our Services on behalf of a company, you agree to be bound by the terms of this End User License Agreement (“EULA”).  If you do not agree to these terms, do not register, access or otherwise use the services of WREN.

If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.

1.0 Scope of Agreement

This EULA is a legal agreement between the End-User, (“You”) and Workforce Development Board Windsor Essex (“Workforce WindsorEssex”, “We”, “Us” or “Ours”) for use of the WREN services, including but not limited to the WREN Jobs Portal.  This agreement governs access to, and all use of, the WREN Jobs Portal.

2.0 Services

This Agreement applies to the Windsor Regional Employment Network (WREN) Jobs Portal. Registered users of these Services are “Members” and unregistered users are “Visitors”.

We use the information and data that you provide and that we have about Members to make recommendations for job posts of interest, content and other features that may be useful to you. For example, we use data and information about you to recommend jobs to you, and you to third party service providers (“Service Providers”). Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.

3.0 Changes to This Agreement

We may modify this Agreement or our Privacy Policy from time to time. If we make material changes to it, we will provide you notice through the WREN Jobs Portal, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may close your account by contacting info@workforcewindsoressex.com. Your continued use of the WREN Jobs Portal after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.

4.0 Obligations

The WREN Jobs Portal is not for use by anyone under the age of 16. To use the Services, you agree that:

  • You must be at least 16 years of age or older; and
  • You will only have one WREN Jobs Portal account, which must be in your real name.  Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or for persons under the age of 16.

When you register and join the WREN Jobs Portal, you become a Member. Members are account holders. You agree to use a strong password and keep it confidential. You agree not to share your account details with others.

5.0 Notices and Messages

You agree that we will provide notices and messages to you in the following ways: (1) within the WREN Jobs Portal Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.   

6.0 Your License to Use WREN Jobs Portal

As between you and Workforce WindsorEssex, you own the content and information that you submit or post to the WREN Jobs Portal Services, and you are only granting us and our affiliates the following non-exclusive license:

  • A worldwide, transferable and sub-licensable right to use, copy, modify, distribute, publish and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others.

7.0 Privacy and Your Personal Information

As a Visitor or Member of our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy, which includes our Cookie Policy.

During registration or after your account has been created, you agree to share your account details and activities with us and our service delivery partners:

  • Workforce Development Board Windsor Essex
  • Corporation of the City of Windsor
  • Government of Ontario
  • Government of Canada
  • Regional Employment Services Organizations

You agree to permit designated representatives from Workforce WindsorEssex and its service delivery partners to access your account for the purposes of a) helping you find a job, b) exploring career options, c) finding training or education opportunities of interest.

You and Workforce WindsorEssex agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings).

You agree that we may store your account details and activities indefinitely, as this is required by the Government of Ontario which funds the employment service programs offered by WREN and/or Workforce WindsorEssex.

8.0 Security

You recognize and agree that:

  1. the internet is not a secure medium.  Accordingly, the privacy of your communications (including, but not limited to communications by email, telephone, or mail), the privacy of your visits to this Website and the WREN Jobs Portal, and the privacy of your content cannot be guaranteed.
  2. the nature of internet communications means that your communications (including, but not limited to, communications by e-mail) may be susceptible to data corruption, unauthorized access, interception and delays the WREN Job Portal and content may include incomplete information, inaccuracies or typographical errors.

9.0 Service Availability

We may change, suspend or discontinue any of our Services.

WREN Jobs Portal is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

10.0 Other Content

By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. We generally do not review content provided by others. You agree that we are not responsible for others’ content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse.

We may help connect Members to Service Providers (career coaching etc.) with Members seeking services. We do not perform nor employ individuals to perform these services. You acknowledge that we do not supervise, direct, control or monitor Service Providers in the performance of these services and agree that (1) Workforce WindsorEssex is not responsible for the offering, performance or procurement of these services, (2) Workforce WindsorEssex does not endorse any particular Service Provider’s offered services, and (3) nothing shall create an employment, agency, or joint venture relationship between Workforce WindsorEssex and any Service Provider offering services.

Similarly, We may help you register for and/or attend events organized by Service Providers or other entities. You agree that (1) Workforce WindsorEssex is not responsible for the conduct of any of the Service Providers or other attendees at such events, (2)Workforce WindsorEssex does not endorse any particular event listed on the WREN Jobs Portal, (3) Workforce WindsorEssex does not review and/or vet any of these events, and (4) that you will adhere to these terms and conditions that apply to such events.

11.0 Limits

We reserve the right to limit your use of the WREN Jobs Portal. We reserve the right to restrict, suspend, or terminate your account if you breach this Agreement or the law or are misusing the WREN Jobs Portal.  

12.0 Disclaimers and Limitations of Liability

Workforce WindsorEssex and its affiliates make no representation or warranty about the WREN Jobs Portal, including any representation that the WREN Jobs Portal will be uninterrupted or error-free, and provide the WREN Jobs Portal on an “as is” and “as available” basis. To the fullest extent permitted under applicable law, Workforce WindsorEssex and its affiliates disclaim any implied or statutory warranty, including any implied warranty of title, accuracy of data, non-infringement, merchantability or fitness for any particular purpose.

To the fullest extent permitted by law (and unless Workforce WindsorEssex  has entered into a separate written agreement that overrides this Agreement), Workforce WindsorEssex and its affiliates will not be liable in connection with this Agreement for any direct, indirect, special, consequential or other damages that result from, or arise in connection with this Agreement, the use or inability to use the WREN Job Portal, the content thereof, including but not limited to, lost profits or lost business opportunities, reputation, loss of data, or any indirect, incidental, consequential, special or punitive damages.

13.0 Indemnification

To the maximum extent permitted by applicable law, you will defend, indemnify and hold Workforce WindsorEssex harmless from and against all claims, liability and expenses, including all legal fees and costs, arising from (i) any material breach of this Agreement by you, (ii) your use of misuse of the WREN Jobs Portal, its content, or any other product or services available through this website, and (iii) content submitted by you.

14.0 Termination

Both you and Workforce WindsorEssex may terminate this Agreement at any time with notice to the other. On termination, you lose the right to access or use the Services. The following shall survive termination:

  • 12.0 “Disclaimers and Limitations of Liability”; 13.0 “Indemnification; 15.0 “Governing Law and Dispute Resolution”; 16.0 “Severability”; 17.0 “Entire Agreement”; and 18.0 “General Terms” sections of this document.
  • Any amounts owed by either party prior to termination remain owed after termination.
  • Your profile data, account details, and activities, as these records are required for auditing purposes by our government funders.

15.0 Governing Law and Dispute Resolution

You and Workforce WindsorEssex agree that the laws of the province of Ontario, Canada, excluding conflict of laws rules, shall exclusively govern any dispute relating to this Agreement and/or the Services. You and Workforce WindsorEssex agree that claims and disputes can be litigated only in the province of Ontario, Canada and we each agree to personal jurisdiction of the courts located in the province of Ontario, Canada.

16.0 Severability

If a court with authority over this Agreement finds any part of it unenforceable, you and we agree that the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, you and we agree to ask the court to remove that unenforceable part and still enforce the rest of this Agreement.

17.0 Entire Agreement

These terms and conditions and any other policies, guidelines or other agreements incorporated or provided by Workforce WindsorEssex constitute the entire agreement between Workforce Windsor Essex and you with respect to your use of the WREN Jobs Portal.  This Agreement (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.

18.0 General Terms

If we do not act to enforce a breach of this Agreement, that does not mean that Workforce WindsorEssex has waived its right to enforce this Agreement. You may not assign or transfer this Agreement (or your membership or use of Services) to anyone without our consent. However, you agree that we may assign this Agreement to our affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Agreement.

The summary of the EULA below is intended to increase your understanding of the legal jargon above but should not be considered the official Agreement. You will need to agree to the Agreement above.

1 – Scope of the Agreement
This agreement is between you and Workforce WindsorEssex and its partners so that you can access the Windsor Regional Employment Network (WREN) Jobs Portal.
2 – Services
If you sign up for, register for, or use the WREN Jobs Portal, your data will be used to recommend jobs or content that might interest you. For that reason, it would be helpful if you kept your profile up to date.
3 – Changes to This Agreement
Some updates to this agreement may be made from time to time but if anything major is changed in the agreement, we will send you a notification through the WREN Jobs Portal or by email or phone that is listed in your account. No changes will be made retroactively. However, if you do not cancel your account with us before the date that the changes come into effect, we will assume that you agree to the changes.
4 – Obligations
You need to be at least 16 years old to use the WREN Jobs Portal. Please keep a strong and confidential password to yourself so that your account is secure.
5 – Notices and Messages
We will provide messages to you in one of two ways: within the WREN Jobs Portal or through the contact information you provided us. For that reason, you will need to keep your information up to date.
6 – Your License to Use WREN Jobs Portal
You give us and others permission to use, copy, change, share, publish, and handle the information and content you provide through our services, anywhere in the world. This permission is transferable and can be passed on to others. You won’t need to give more consent, get a notice, or receive any payment for this.
7 – Privacy and Your Personal Information
When your account is created, you will be sharing your information with:
– Workforce WindsorEssex
– The Corporation of the City of Windsor
– The Government of Ontario
– The Government of Canada
– Regional Employment Services Organizations
You give permission for representatives of the organizations to access your information to help you find a job, explore career options, or find training and education oportunities.
We may store your information and activities indefinitely, as required by the Government of Ontario who funds this system and service.
8 – Security
You recognize and agree that the internet is not always secure and so the privacy of your visits to the website and your content cannot be guaranteed. The nature of the internet means that you may be susceptible to unauthorized data access or corruption.
9 – Service Availability
We can change, suspend or cancel access to our Services. Outside of our legal obligations, you agree that we do not need to store, maintain or provide you copies of content or information that you or others provide in the system.
10 – Other Content
Some content on the website is brought in from other sources, including from service providers, news outlets, and reporting systems. In other cases, the website or content may not be up to date with newly released program guidelines, policies, or best practices. While the WREN works to keep the information as up to date as possible, some information you find may be inaccurate, incomplete, delayed, missing, illegal, offensive or otherwise harmful.
Workforce WindsorEssex does not employ the staff or supervisors responsible for providing services so you acknowledge that we do not favour or endorse one over another and nothing will create an explicit partnerhsip or joint venture with a service provider.
At the same time, we will help you connect to service providers, but will not be responsible for their actions or conduct, or content, at events or during service delivery.
11 – Limits
We can limit your use of the WREN Jobs Portal if you break the law or this agreement or if you misuse the WREN Jobs Portal.
12 – Disclaimers and Limitations of Liability
We cannot always guarantee access to the WREN Jobs Portal, as systems can be interrupted from time to time. Workforce WindsorEssex will not be liable for any direct, indirect, or other damage that result from this Agreement, use of or inability to use the WREN Jobs Portal, the content, including lost profit, lost business opportunities, loss of data, or other damages.
13 – Indemnification
You will not hold Workforce WindsorEssex financially or professionally responsible for any breach of this agreement by you or your misuse of the WREN Jobs Portal. As much as the law allows, you agree to protect, compensate, and not hold Workforce WindsorEssex responsible for any claims, liabilities, and costs, including legal fees, that arise from:
(i) you breaking any part of this Agreement,
(ii) your use or misuse of the WREN Jobs Portal, its content, or any other products or services available through this website, and
(iii) any content you submit.
14 – Termination
Both you and Workforce WindsorEssex can end this Agreement at any time without notice. When it is terminated, you will no longer be able to access the service. Even once the Agreement has ended, sections 12, 13, 15, 16, 17, and 18 will still be in effect. Any money owed by either party at the time the agreement ends, will carry forward and any information being held will continue to be held to allow for required government reporting.
15 – Governing Law and Dispute Resolution
The laws in the Province of Ontario and in Canada will govern any conflict we dispute that may come up related to this Agreement. If litigation is needed, it will only be done in Ontario.
16 – Severability
If any part of the Agreement can’t be enforced, it will be updated to still maintain the intent of the original agreement.
17 – Entire Agreement
This agreement is the only one between us regarding employment services, and replaces any previous agreements for service.
18 – General Terms
Even if Workforce WindsorEssex doesn’t enforce all parts of this agreement at all times, it does not mean that it is not in effect. This agreement is also not transferable to another person or entity.
